Please read these terms before using Memry. Using the app means you accept them.
These Terms of Use ("Terms") govern your access to and use of the Memry website and mobile application ("Memry," "we," "our," or "us"). By using Memry, you agree to these Terms.
By downloading, installing, accessing, or using Memry, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the app.
The Memry iOS app is licensed (not sold) to you through Apple's App Store. Your license to use the app is governed by Apple's Standard Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula, in addition to these Terms. To the extent these Terms conflict with Apple's Standard EULA, Apple's Standard EULA governs the license to use the app.
Apple is not a party to these Terms and is not responsible for the Memry app or its content. Memry, not Apple, is solely responsible for maintenance and support, any product warranties, and any claims relating to the app, including intellectual-property, product-liability, consumer-protection, and regulatory-compliance claims. You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as the end user.
Memry offers an optional auto-renewing subscription, Memry Plus, billed annually, as well as a one-time Founding Lifetime purchase. All purchases are made through Apple's App Store and charged to your Apple Account upon confirmation of purchase. The subscription title, length, and price are shown in the app at the point of purchase and may vary by region.
A Memry Plus subscription automatically renews for the same period unless it is cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription at any time in your Apple Account settings; cancellation takes effect at the end of the current billing period, and no partial refunds are provided for an unused portion of a term. The Founding Lifetime option is a one-time purchase and does not renew.
Payments, billing, cancellations, and refunds are handled by Apple in accordance with Apple's Standard End User License Agreement (EULA) and the App Store Terms of Sale. We are unable to process payments or issue refunds directly; refund requests must be made through Apple.
You may use Memry for personal, non-commercial purposes in accordance with these Terms and any applicable laws. You are responsible for the device, network, and account you use to access the app.
You retain ownership of the content you add to Memry, including collections, items, notes, photos, dates, locations, and tags. You are responsible for the content you create and for ensuring you have the right to add it. We do not claim ownership of your personal content and we do not sell it.

Memry, including its name, branding, design, software, graphics, and content (other than user-created content), is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the app without our permission.
We strive to keep Memry available and reliable, but we cannot guarantee that the app will always be accessible, error-free, or uninterrupted. We may update, modify, suspend, or discontinue features at any time, with or without notice.
Memry is provided "as is" and "as available," without warranties of any kind, either express or implied, to the fullest extent permitted by law. We do not warrant that the app will meet your requirements, be uninterrupted, secure, or free from errors, defects, or loss of data.
To the fullest extent permitted by law, Memry and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or use, arising out of or related to your use of the app. Your sole remedy for dissatisfaction with the app is to stop using it.
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Your continued use of Memry after changes are posted constitutes acceptance of the revised Terms.
